This Criminal Miscellaneous Petition has been filed by the petitioner seeking to condone the delay of 59 days in filing the main Criminal Appeal against the order dated 29.12.2023 in C.C.No.379 of 2014 on the file of the Judicial Magistrate No.5, Coimbatore.

2. Heard both sides.

3. Satisfied with the reasons stated in the affidavit in support of this petition and considering the delay, this Court considers it appropriate to allow this petition on payment of costs. Accordingly, this miscellaneous petition is allowed and the delay of 59 days in filing the above appeal, is condoned subject to payment of Rs.5,000/- (Rupees Five Thousand only) to the respondent within a period of two weeks from the date of receipt of this order, failing which, the petition shall stand dismissed automatically, without further reference to this Court.
