Mr.K.Tippu Sultan, learned Government Advocate accepts notice for R1and is armed with instructions to enable a final disposal of this Writ Petition, even at the stage of admission.
2. The prayer of the petitioner is for a mandamus directing the Secretary to Government, Health and Family Welfare Department/R1 to recover the amounts stated to have been paid by the petitioner from the second respondent, D.D. Medical College and D.D.Hospital.
3. The petitioner places reliance on an order dated 13.10.2023 passed in W.P.(MD) No.1231, 1256 and 1263 of 2020. It is unknown as to why Medical Council of India has been arrayed as a respondent.
4. Be that as it may, since Mr.Tippu Sultan accedes to the pendency of representation dated 06.11.2023 in view of the acknowledgement placed at page 33 of the typed set, and also states that the needful will be done in disposing the same in accordance with law, mandamus is issued to R1 to hear the petitioner as well as R2, obtain inputs from R3, if required and dispose representation dated 06.11.2023 within a period of twelve (12) weeks from date of receipt of a copy of this 2/4
order, in accordance with law and all extant Rules and Regulations.
5. This Writ Petition is disposed as above.
