ORDER
The petitioners apprehend arrest for the alleged offence under Sections 69, 115(2), 296(b) and 351(2) of BNS (323, 294 and 506(ii) IPC), in Crime No.01 of 2026 on the file of the respondent police seek anticipatory bail.
2.The case of the prosecution is that the 1st petitioner and the defacto complainant loved each other, and that the 1st petitioner under the premise of marrying her, committed sexual intercourse on several occasions and thereafter cheated the defacto complainant. When the same was questioned, the 1st petitioner along with other accused assaulted, abused and threatened her with dire consequences. Hence the complaint.
3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and objected for the grant of anticipatory bail.
5. Considering the fact that the 1st petitioner under the guise of marrying the defacto complainant had physical relationship with her and thereafter cheated and also abused and assaulted her. Hence, this Court considering the nature of offence committed by the petitioners, is not inclined to grant anticipatory bail.
