Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Appeal No.157/2018 on the file of the High Court, the High Court will be pleased to suspend the sentence imposed by the Learned Mahalir Judge, Special Court for Cases Under POSCO ACT 2012 Mahila Court, Chennai dated 19.01.2017 in S.C.No.32 of 2015 and enlarging him on bail pending disposal of the above appeal No.157 of 2018.
Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl. Appeal No.157/2018 on the file of the High Court and upon hearing the arguments of M/S.N.SUDHARSAN Advocate for the petitioner and of MR.T.SHANMUGARAJESWARAN Government Advocate on behalf of the Respondent the court made the following order:- The learned counsel for the petitioner seeks to suspend the conviction and sentence imposed on the petitioner, pending appeal.
2. It is seen from the evidence of PW1 (the mother of the victim), PW2, PW3 (the land lady) in whose house PW1 and accused were residing in separate portion. PW4 is the daughter-in-law of PW3. The trial Court after appreciating the evidence of PW1, PW3 and PW4 has awarded the sentence and in view of our whelming evidence and evidence which stands corroborated with each other and specific finding of the Sessions Court, I am not inclined to suspend the sentence for the present. Hence, this Civil Miscellaneous Petition is dismissed for the present.
