ORDER

This petition has been filed to direct the Respondent herein not to harass the petitioner.

2.It is seen from the records that the petitioner is not an accused in Crime No.817 of 2008. Already the respondent police have issued a summon to the petitioner on 07.11.2017 and the petitioner had also appeared before the respondent police and given his statement.

3.The grievance of the petitioner is that the petitioner is being harassed by respondent police by repeatedly calling him for enquiry.

4.The learned Additional Public Prosecutor appearing on behalf of the respondent submitted that the respondent police do not have any intention to harass the petitioner and that the petitioner can appear once for the enquiry after the issuance of summon by the respondent police.

5.Taking into consideration the facts and circumstances of the case, it is made clear that the respondent police shall not harass the petitioner and the respondent police if they want to conduct any further enquiry, shall issue summon to the petitioner and the enquiry shall be completed immediately. The F.I.R. has been pending from the year 2008 onwards, without any progress.

6.This Criminal Original Petition is disposed of with the above direction.
