..Respondents Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus directing the respondents to continue the petitioner-workmen upto the age of 60 years as per Certifying
Officer order, dated 06.03.2015 and confirmed on 20.11.2015 under the Industrial Employment (Standing Orders) Act, 1946 as the 1st respondent has agreed to absorb them by an agreement dated 25.04.2013 in overall settlement of the Award dated 16.02.2006 passed in I.D.No.592 of 2001. For Petitioners:

ORDER
This Writ Petition is filed for issuance of a Writ of Mandamus to 26 of the Constitution of India, praying for issuance of a Writ of Mandamus directing the respondents to continue the petitioners-workmen upto the age of 60 years as per Certifying Officer order, dated 06.03.2015 and confirmed on 20.11.2015 under the Industrial Employment (Standing Orders) Act, 1946, as the first respondent has agreed to absorb them by an agreement dated 25.04.2013 in overall settlement of the Award dated 16.02.2006 passed in I.D.No.592 of 2001.
2. This Court, by order dated 28.06.2024, has directed the parties to maintain status-quo in respect of the services of petitioners and not to dispense with their services until next date of hearing.
3. It is not in dispute that, pursuant to the above said interim order passed by this Court, the petitioners are continuing in service and this Court has
directed the Management to request the contractor, in respect of the continuation of the services of the petitioners.
4. The fact remains that the petitioners will attain the age of 60 years on 30.06.2026. In view of the same, this Writ Petition is disposed of, with a direction to the respondents to permit the petitioners to retire and extend all superannuation benefits to them and the Management is directed to pay the benefits, for which both the petitioners, are entitled to.
5. With the above observations/directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the miscellaneous petitions are closed.
