ORDER

The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 420, 468, 471, 120B, 294(b) and 506(i) of IPC, in Crime No.02 of 2026 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that the petitioner along with other two accused promised 25 persons including the de facto complainant, for employment in Canada and collected a sum of Rs.80,00,000/- along with their Educational Certificates and other documents. They neither secured the job nor returned the money and thereby, cheated the victims. Hence, the case.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution. He further submits that the petitioner does not have any knowledge of the alleged promise of overseas employment or financial transactions and he did not derive any monetary benefits out of the alleged transactions. He further submits that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court and hence, he prays to grant anticipatory bail to the petitioner.

The case of the prosecution as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner neither secured the job to the victims nor returned the money to them and thereby, cheated the victims to the tune of Rs.80,00,000/-. He further submits that that this is the second bail application and the previous application in Crl.O.P.No.9169 of 2026 has been dismissed by

this Court on 10.04.2026. He would also submit that there is no change in circumstances in the present application.

Considering the gravity of the offences and upon the ground that there is no change in circumstances, this Court is not inclined to grant anticipatory bail.
