( Criminal Jurisdiction ) Monday, the Tenth day of December Two Thousand Eighteen PRESENT The Hon`ble Mr Justice V.PARTHIBAN CRIMINAL MISCELLANEOUS PETITION No.3761 of 2018 IN CRL RC.315/2018 R.ARUNRAM [ PETITIONER ] Vs S.SELVAM [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Revision Case No.315/2018 on the file of the High Court, the High Court will be pleased to suspend the execution of the sentences dated 19/04/2017 passed in C.C.No.1686 of 2015 by the Honble Judge of MetroPolitan Magistrate, Fast Track Court- IV at George Town which was confirmed by the Honble Judge of XVi Additional, City Civil Court at Chennai by order dated 07/1/2017 passed in Crl.A.No.129 of 2017 pending disposal of the above Crl.Revision Case No.315/2018.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.Revision Case No.315/2018 on the file of the High Court and upon hearing the arguments of M/S.S.GURU MOORTHY, Advocate for the petitioner and of MR.NARAYANANSAMY on behalf of the Respondent the court made the following order:- Earlier, this Court vide its order dated 12.03.2018, inter alia imposed a condition that the petitioner shall deposit 50% of the cheque amount before the learned Metropolitan Magistrate, Fast Track No.IV, George Town, Chennai, within a period of four weeks.

2. When the matter is taken up for hearing today, it is represented by the learned counsel for the respondent that the said condition has not been complied with by the petitioner. Therefore, he seeks to vacate the order of suspension of sentence.

3. On behalf of the petitioner, there is no effective representation as to why the condition imposed by this Court has not been complied with.

4. Therefore, this Court is of the view that the suspension of sentence which is granted on the basis of the condition need not be continued any further. Therefore, the same is vacated. https://hcservices.ecourts.gov.in/hcservices/
