Defendants Prayer: Civil Suit filed under Order IV Rule 1 read with Order XXIV of the Original Side Rules read with Order VII Rule 1 Civil Procedure Code, praying to pass the following judgment and decree against the defendants. a) for partition by metes and bounds and for separate possession of the plaintiff's one-half share in the suit property, described in the schedule hereunder; b) to declare Will dated 22.10.2001 executed by late Mr.R.Jambulingam as null and void and not binding on the plaintiffs;

c) directing the first defendant to remit a sum of Rs.2,71,640/- to the plaintiff, being arrears of rent 1/3

withhold by him;

d) directing the first defendant to pay further interest at 24% per annum on the principal sum of Rs.2,71,640/- from the date of presentation date 16.06.2014 of plaint till date of realization in full;

e) for costs of the suit.

JUDGMENT

When the matter came up for hearing today, the learned counsel for the plaintiff submitted that he is not pressing this suit since the mater has been settled out of court between the parties and he has also made an endorsement to that effect.
