Writ Petition(Crl.) filed under Article 226 of Constitution of India praying to issue a WRIT OF MANDAMUS directing the 1st and 2nd Respondents herein to take legal action against the 3rd Respondent and consequently direct the 3rd Respondent herein to release the lorry (Reg.No.TN32AZ 3389) seized from the Petitioner, and unlawfully retained in the SIBI Yard, located at Siruvangur Road, Kallakurichi Authority, by receiving the three month EMI amount (without penalty, recovery charges and other charges) from the petitioner and further directing the 3rd Respondent to compensate the Petitioner for the loss of Rs.50,000/- out of the unlawful seizure done by 3rd Respondent and imposing exemplary cost against the 3rd Respondent for litigation expenses within in time frame that may be fixed by this Court. ORDER
This writ petition has been filed praying to issue a direction
to the 1st and 2nd Respondents herein to take legal action against the 3rd Respondent and consequently to direct the 3rd Respondent herein to release the lorry (Reg.No.TN32AZ 3389) seized from the Petitioner and unlawfully retained in the SIBI Yard, located at Siruvangur Road, Kallakurichi Authority, by receiving the three month EMI amount (without penalty, recovery charges and other charges) from the petitioner and further directing the 3rd Respondent to compensate the Petitioner for the loss of Rs.50,000/- out of the unlawful seizure done by 3rd Respondent and imposing exemplary cost against the 3rd Respondent for litigation expenses within in time frame that may be fixed by this Court. 2.
The learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for respondents 1 & 2 submitted that enquiry was conducted in CSR.No.360 of 2026 and the same was closed. 3.
Recording the above submission, this writ petition is closed. There shall be no order as to costs.
