The 1st defendant has filed this present petition seeking to condone the delay of ll days in filing the written statement.

2. In the affidavit filed, it had been stated that the 1st defendant is a widow and Senior Citizen and had cataract in both the eyes. It was stated that the 2nd defendant was in Singapore and she only took care of the 1st defendant. It was also stated that in the meanwhile, the pandemic situation also crept in. In view of all these reasons, it had been stated that there has been a delay of 11 days in filing the written statement.

3. The learned Master had condoned the delay in representing the written statement. It is only a consequential application.

4. In view of the reasons stated, the application stands allowed. The delay is condoned. The written statement of the 1st defendant is taken on file.

Call the suit again on 27.10.2022.
