ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.10.2025 for the alleged offence under 8(c), r/w.20(b)(ii)(C) of NDPS Act in Crime No.143 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was found to be

possession of 21 kgs of Ganja. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. It is the further submission of the learned counsel for the petitioner that the petitioner is not the owner of the vehicle in question. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and strongly opposed the grant of bail to the petitioner.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); considering the involvement of commercial quantity involved and from the submissions made by the learned Government Counsel (Criminal Side), to overcome the rigour under Section 37 of NDPS Act, this Court could not find any material.

Hence, this Court is not inclined to grant bail to the petitioner.
