The Second Appeal filed under Section 100 of the Civil Procedure Code against the judgment and decree passed in A.S.No.70 of 2012 dated 07.02.2013 on the file of the Principal District Judge, Krishnagiri, confirming the judgment and decree dated 28.06.2012 in O.S.No.222 of 2010 on the file of the Principal Sub Court, Krishnagiri.

J U D G M E N T

Aggrieved over judgment and decree dated 07.02.2013 passed in A.S.No.70 of 2012 by the learned Principal District Judge, Krishnagiri, confirming the judgment and decree dated 28.06.2012 passed in O.S.No.222 of 2010 by the learned Principal Sub Judge, Krishnagiri, the appellant / defendant has preferred the above Second Appeal.

2.When the matter is taken up for final disposal, Mr.V.Rameshvel, learned counsel for the appellant would submit that he has instruction from the appellant that he will abide by the preliminary decree granted by the Trial Court and that the final decree proceedings are going on.

3.Mr.P.M.Duraisamy, learned counsel for the respondent would submit that three months time would be sufficient to complete the final decree proceedings.

4.Recording the submissions made by the learned counsel on either side, a direction is given to the Trial Court to complete final decree proceedings within a period of three months from the date of receipt of a copy of this order.

5.The Second Appeal is dismissed with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
