The petitioner / A1 who was arrested and remanded to judicial custody on 19.03.2023 for the offence punishable under Sections 8(c) read with Section 20(b)(ii)(C), 29(1) of NDPS Act in Crime No.102 of 2023 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the accused were found in possession of 21 Kgs of Ganja. Hence the case was registered against the petitioner.
3. It is stated that though investigation has been completed and final report had also been filed and the same is taken cognizance as C.C.No.708 of 2023, the trial is yet to commence.
4. The earlier application seeking bail was dismissed on 06.10.2023. Thereafter, with respect to A2, bail was granted on 25.06.2024. But it had been observed that the entire contraband has been seized only from this petitioner and the contraband seized is of commercial quantity. No ground has been stated that the petitioner would be acquitted after conclusion of the trial. Taking into consideration all factors, this bail application stands dismissed.
