Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to survey the property comprised in SF.No.258/1B and 258/2 at Chandrapillai Valasai Village at Vazhapadi Taluk, Salem District by considering the representation of the petitioner herein dated 20.01.2024 within a reasonable time as fixed by this Court.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This Writ Petition is filed to direct respondents to survey the property comprised in SF.No.258/1B and 258/2 at Chandrapillai Valasai Village at Vazhapadi Taluk, Salem District by considering the representation of the petitioners herein dated 20.01.2024 within a reasonable time as fixed by this Court.

3. Heard learned counsel for the petitioners and the learned Special Government Pleader appearing for the respondent and perused the materials available on record.

4. The case of the petitioners is that the subject properties have been settled in favour of the petitioners by a registered settlement deeds dated 02.07.2015 and the petitioners are in possession and doing agriculture in the said lands. The grievance of the petitioners is that though they had given a representation to the respondents on 20.01.2024 to survey their property and 2/4

also paid necessary fees, the respondents have not considered the representation of the petitioners. Hence, the present Writ Petition.

5. Considering the limited relief sought for in this writ petition, the respondents are directed to consider the representation of the petitioners dated 20.01.2024 and pass appropriate orders on the same, after giving notice to the neighbouring land owners and any other interested persons, within a period of two months from the date of receipt of a copy of this order.
