This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 20.02.2025, seeking bail in Crime No.40 of 2025 registered for the offences under Sections 331(4) Page No.1 of 5

and 305 of BNS Act, 2023.

2. It is the case of the prosecution that the petitioner robbed a sum of Rs.7,80,000/- and 26 sovereigns of gold from the house of the defacto complainant. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in custody from 20.02.2025, and that in any case, further custody of the petitioner is not required and prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police, while opposing the grant of bail to the petitioner, reiterated the prosecution case and, on instructions, submitted that the petitioner has 46 previous cases to his name.

available on record.

6. Considering the gravity of the offence, and taking into account the petitioner's criminal antecedents with 46 previous cases, this Court is of the view that this is not a fit case for grant of bail at this stage.
