This Civil Miscellaneous Petition has been filed seeking to set aside the order dated 14.02.2022 dismissing the above Civil Revision Petition for non-prosecution.
2. Ms.S.Sridevi, learned counsel for revision petitioner submitted that as the petitioner's counsel on record died, the other counsels did not notice the listing of case, due to that, it was dismissed for default. Thereafter, the petitioner engaged the present counsel on record, and after verifying the records, she came know about the same and filed this petition to restore the C.R.P. within time. Hence, he prayed that this petition may be allowed.
3. Ms.R.Thenmirtha Shyamala, learned counsel appearing for respondents 2 and 3 appeared and submitted that she has no objection for allowing this petition.
4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit filed in support of the petition, this Court is inclined to allow this petition and to restore the Civil Revision Petition.
