C.M.P.No.15262 of 2024 C.M.P.No.15262 of 2024 in W.A.Sr.No.60293 of 2024 M.S.RAMESH, J., and C.KUMARAPPAN, J., (Order of this Court was delivered by M.S.RAMESH.J.,) This petition is filed to condone the delay of 182 days in filing the accompanying writ appeal, against the judgment dated 22.11.2023 passed by this Court in W.P.No.30629 of 2012.

2. On the ground that after the order of the learned Single Judge came to be passed, the appellant herein could not contact his counsel, delay has occurred in preferring the present Writ Appeal and hence, filed the present application, seeking for condonation of the delay.

3. Learned counsel for the first respondent / Management would submit that the reason assigned by the workman for the unauthorized absence was not satisfactory and hence, he had rightly dismissed him from service.

4. Whether the enquiry conducted against the workman was fair and proper would be adjudicated at a later stage. However, this is an application seeking only https://www.mhc.tn.gov.in/judis Page No.1/2

C.M.P.No.15262 of 2024 M.S.RAMESH, J., and C.KUMARAPPAN, J., Anu for condonation of the delay in preferring the appeal and no objections have been raised with regard to the reasons assigned for not preferring the appeal in time. Hence, we are inclined to condone the delay. Accordingly, the delay stands condoned and this petition is allowed.
