Petition filed under section 226 of the Constitution of India to issue a Writ of Mandamus directing the third respondent to allow the student's of the petitioner's school to right their X Std examination for the Academic year 2013-14 on based on our application dated 05.12.2011, seeking temporary recognition for the Academic Year 2013-14, for running the classes LKG to X Standard in St. John Matriculation School, Vellore.

ORDER

Heard Mr.A.Abdul Rahman, learned counsel for the petitioner and Mr.V.Jayaprakash Naraynan, learned Special Government Pleader for Respondents 1 to 3.

2. The petitioner is the Correspondent of the St. John Matriculation School at No.29, Officer's Lane, Vellore-632 001 and he has filed the writ petition seeking for issuance of Writ of Mandamus directing the third respondent to permit the students of the petitioner's School to write their X Standard examination for the Academic Year 2013-14, since there was an application for temporary recognition for the Academic Year 2013-14 vide application dated 05.12.2011.

3. It is seen that pursuant to the interim order granted by this Court dated 12.12.2013, the students had written the examination and the said application for temporary recognition is still pending. Therefore, to that extent, a direction sought for in the application has become infructuous. However, for the subsequent Academic years, the students shall be permitted to continue to write the examination. It is submitted by the learned counsel for the petitioner that the application for recognition is still pending. 4.In the light of the above, it is open to the respondentAuthority to consider the application dated 05.12.2011 of the petitioner and pass orders on merits and in accordance with law, as expeditiously as possible.

With the above observation, the writ petition is disposed of. No costs.
