This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 25.05.2025, seeking bail in Crime No.2 of 2021 registered for the offences under Sections 363, 366 of IPC and Section 5(l) r/w Section 6 of POCSO Act and under Section 9 of the Page No.1 of 5

Child Marriage Act.

2. It is the case of the prosecution that the petitioner had sexual intercourse with the victim, who is a minor girl, aged 17 years. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in custody from 25.05.2025, and that in any case, further custody of the petitioner is not required and prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police, while opposing the grant of bail to the petitioner, reiterated the prosecution case.

5. Heard learned counsel on either side and perused the materials available on record.

6. Considering the seriousness of the allegation, the stage of investigation, and the possibility of the petitioner tampering with evidence or influencing the witnesses, this Court is not inclined to grant bail to the petitioner at this stage.
