Order The Court made the following order :- The petitioner is the accused in Crime No.121 of 2026 on the file of Mecheri Police Station and was arrested and remanded to judicial custody on 05.04.2026 for the offences under Sections 331(4) and 62 of the Bharatiya Nyaya Sanhita, 2023, later altered to Sections 310(4) and 312 of BNS, and seeks bail.

The case of the prosecution is that on 28.03.2026 at about 1.00 a.m., when the defacto complainant and his wife were sleeping in their house, the petitioner and other accused, with an intention to commit robbery, attempted to break open the main door using an iron rod. On hearing the noise raised by the defacto complainant and his wife, the accused fled from the scene. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has not committed any offence as alleged by the prosecution. However, he was arrested and has been in judicial custody since 05.04.2026. Therefore, he prayed for grant of bail.

4. The learned Additional Public Prosecutor appearing for the respondent

police opposed the bail application stating that there are seven previous cases pending against the petitioner. He reiterated the allegations levelled against the petitioner and further submitted that the bail application filed by the co-accused was dismissed by this Court on 21.04.2026 and there is no change in circumstances. It was also submitted that the petitioner had earlier filed a Criminal Miscellaneous Petition in Crl.M.P.No.1008 of 2026 before the learned Principal Sessions Judge, Salem, which was dismissed by order dated 22.04.2026.

5. Considering the facts and circumstances of the case, the nature of allegations levelled against the petitioner, and the other attending circumstances, this Court is not inclined to grant bail to the petitioner. In the result, this Criminal Miscellaneous Petition is dismissed. No costs. 07-05-2026 Index: Yes/No Speaking/Non-speaking order JRS
