The petitioners/A2 and A3 in Crime No.21 of 2023, registered by the respondent police for the offences punishable under Sections 406 & 420 of IPC r/w 120(B) of IPC, seeks anticipatory bail.
2.It must be mentioned even at the outset, that the learned counsel for the petitioner deserted the petitioner and had taken a concious decision not to appear before the Court. The matter had been adjourned again and again and hoping that the learned counsel would atleast enter the Court hall, but he has not represented the matter at all. It is seen that also an application has been filed seeking to intervene in the said issue.
3.It is the case of the prosecution that the present petitioner/A2 wife of A1, and A3 father-in-law of A1 and all the three accused, had taken a sum of Rs.1,13,30,000/- from the defacto complainant, out of which Rs.30,00,000/- was paid by cash and balance of Rs.83,30,000/- was paid by bank transfer They promised to get higher dividend.

4.It is also stated that the accused persons have not appeared even when notices under Section 41-A of Cr.P.C., have been issued. Anticipatory bail application of the 1st accused had been dismissed on 16.10.2023 as dismissed as withdrawn.
5.Since the accused persons have no intention to participate in the judicial proceedings, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. Connected, Criminal Miscellaneous Petition/Intervening Petition is closed. 11.12.2023 ata 2/3
