O R D E R
This writ petition has been filed for a direction to the respondents to grant permission to the petitioner to undergo fasting continuously with respect to the so-called Will that was executed by the former Chief Minister Selvi J Jayalalithaa.
2. The petitioner was present in person and he argued his case. This Court also carefully perused the materials available on record.
3. The petitioner had approached this Court and filed W.P.No.25066 of 2022 for similar prayer. The said writ petition was disposed of by this Court by an order dated 12.10.2022 directing the Commissioner of Police to consider the representation and to take a decision within three (3) weeks.
4. Pursuant to the above order, the Commissioner of Police, through proceedings dated 17.02.2023, rejected the request made by the petitioner. Even thereafter, the petitioner had sought for permission to undergo fasting in any other place near Valluvar Kottam. Since the same was not considered, the present writ petition has been filed before this Court. 2/4
5. In the considered view of this Court, this Writ Petition has been filed only with an intention to seek for publicity. The grievance that has been expressed by the petitioner does not require any public protest by undergoing fasting. According to the petitioner, the former Chief Minister Selvi J Jayalalithaa had executed some Will and the same has not been disclosed to the public. It is not known as to why the petitioner is so much interested on the Will that was executed by the former Chief Minister Selvi J Jayalalithaa. For this purpose, the petitioner wants to sit on a dharna. It is nothing but a cheap publicity that is being attempted to be made by the petitioner. The time of this Court is being wasted repeatedly and the police have other important functions to perform rather than considering the representation made by the petitioner, which has absolutely no substance. This Court does not find any merit in this Writ Petition and accordingly, the same is hereby dismissed. No costs. 26.07.2023 Index : Yes/No Speaking order:Yes/No gm 3/4
