Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of MANDAMUS directing the 2nd respondent to give reply to the letter No.3788/2013 A4 dated 29.08.2013 of the first respondent, after receiving the same from the 2nd respondent and the 1st respondent may be directed to issue Legal Heirship Certificate on the basis of the representation daetd 18.07.2013 of the petitioner. ORDER
Heard M/s.K.Jenitha, learned counsel for the petitioner and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader accepting notice on behalf of the respondents and with their consent, the writ petition is disposed of at the admission stage itself.
2.The petitioner seeks for issuance of Writ of Mandamus to direct the 2nd respondent to furnish reply to the query raised by the 1st respondent vide his communication dated 29.08.2013 for the purpose of considering the petitioner's application for grant of Legal Heirship Certificate.
3.It is seen that the 1st respondent has sought for certain clarification from the 2nd respondent vide proceedings dated 25.07.2014 to enable the 1st respondent to process the application given by the petitioner for issuance of Legal Heirship Certificate. https://hcservices.ecourts.gov.in/hcservices/
Till date the 2nd respondent has not given any reply to the 1st respondent which has necessitated the petitioner to approach this Court by filing this writ petition after seeking for appropriate information under the Right to Information Act, 2005. 4.In the light of the above, there will be a direction to the 2nd respondent to give suitable reply to the 1st respondent pursuant to his communication dated 25.07.2014 within a period of three weeks from the date of receipt of a copy of this order. Thereafter, it is open to the 1st respondent to consider the petitioner's application for grant of Legal Heirship Certificate on merits and in accordance with law within a period of six weeks from the date on which the clarification is received from the 2nd respondent, after issuing notice to the petitioner.
5.The writ petition is disposed of with the above direction. No costs.
