....Respondent PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent to conduct further investigation and include the offence under Section 307 of I.P.C. committed by the accused as stated in the complaint dated 20.04.2021 in the F.I.R. in Crime No.365 of 2021.

ORDER

(This case has been heard through video conference) The petitioner, who is wife of one Tamilsirpi, who was brutally attacked, for which, she lodged a complaint in Crime No.365 of 2021 for offence under Sections 294(b), 323 and 506

(2) of I.P.C. registered. So far, no investigation done in this case. Further, the petitioner's husband was brutally attacked and he sustained injuries. The complaint would clearly disclose the offence attempted to murder. Despite the same, no section included in the F.I.R.

The petitioner also sent a representation to the respondent police and higher officials, but no action taken.

2. The learned Additional Public Prosecutor appearing for respondent would submit that the petitioner's representation was considered and medical records was also considered. Doctor was https://hcservices.ecourts.gov.in/hcservices/

examined, and the investigation is at the final stage, soon the final report would be filed preferably within a period of one month. The grievance of the petitioner would be considered and notice would be issued to the petitioner.

3. On filing of the final report, if the petitioner is aggrieved that appropriate offences are not included in the final report and the representation of the petitioner is not considered, the petitioner is at liberty to file a protest petition before the concerned court with supporting materials.

4. With the above direction, this Criminal Original Petition is disposed of.
