This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 30.05.2024, seeking bail in Crime No.2 of 2024 for the alleged offences punishable under Sections 406, 417 & 420 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that there was money transaction between the de facto complainant and the sister of the petitioner and due to the dispute concerning the repayment of loan, the de facto complainant has lodged a false complaint. He further submitted that the petitioner is in custody from 30.05.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for bail.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police objected for granting bail to the petitioner stating that the accused/petitioner has induced the de facto complainant under the guise of securing a job for him at TNEB, had received a sum of Rs.14,80,000/- from him and when the de facto complainant asked to repay the amount, the accused cheated him by issuing dishonoured cheque. https://www.mhc.tn.gov.in/judis

He further submitted that several previous cases of similar nature are pending against the petitioner and the investigation in this case has not been completed and no recovery was made from the petitioner. Therefore, if he is released on bail, there may be a possibility of him absconding and not available for further investigation.

5. Taking into consideration the submissions made by the learned Government Advocate (Criminal Side) that the investigation in this case is still pending and also considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
