O R D E R
This criminal original petition has been filed seeking to set aside the order passed in Crl.M.P.No.6944 of 2020 on the file of the Learned Principal Sessions Court, Chennai. 2.The Case of the prosecution is that the Learned Principal Sessions Judge, Chennai passed an order granting Anticipatory bail to the Petitioners in Crl.M.P.No.6944 of 2020 on 24.06.2021 for the offences under section 406, 420 and 506(ii) of IPC in Crime No.32 of 2020 to deposit Rs.2,00,000/- to the credit of the above said crime number before the court concerned and also to appear before the Respondent Police s and when required for interrogation. The petitioners submits that they were unable to comply with the conditions within the stipulated time due to the pandemic situation.
Hence the petitioners filed a petition to extend the time before the Learned Principal Session Court, Chennai in Crl.M.P.No.1136 of 2021 and the same was allowed on 09.07.2021 but again the petitioners could not comply the order due to financial crisis faced by the petitioners due to pandemic situation. filed Crl.M.P.No.12228 of 2021 and the same was dismissed on 29.07.2021. Hence, the petitioners filed this present petition seeking extension of time to comply the condition imposed by the Learned Principal Sessions Judge, Chennai.
3. Learned Counsel appearing for the petitioners submits that the petitioners were unable to comply the conditions imposed by the Learned Principal Sessions Judge since they were facing financial crisis and they were unable to mobilize the funds to comply the order within the stipulated time. Hence, he prays for the grant of extension of time for complying the condition.
4. Learned Counsel appearing for the respondent submits that already extension of time was granted to the petitioner for a period of 15 days and the matter was pending before Mediation sufficiently for a long period of time. Hence, it appears there is no intention for the petitioners to settle the matter.
5. Though such a stand is taken by the respondents, however, in the interest of the Justice, one last chance may be granted to the petitioner. Accordingly, I am inclined to further extend the time for two weeks for the petitioner to comply the conditions imposed by the Learned Principal Sessions Judge as a last chance, failing to which the Anticipatory bail granted by the Principal Sessions Judge will stand automatically dismissed.
6. Accordingly, this Criminal Original Petition is disposed of.
