Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents No.2 to 3 to take an appropriate legal action and recover the public money under the Chief Minister Solar Powered Green House Scheme from the 4th respondent in view of order passed by this Honourable Court in W.P. No. 20854 of 2003 dated 4.7.2016.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) The writ petition appears to have been instituted out of the petitioner's angst against the private respondent herein. The writ petitioner has disclosed a previous order dated July 4, 2016 by which a similar petition was dismissed as it was perceived that the matter did not involve any element of public interest.

2. However, the petitioner complains that despite representations to the respondent authorities that the private respondent was not qualified to obtain any benefit under the relevant government scheme, no response has been forthcoming.

3. Mr.P.Muthukumar, learned State Government Pleader, takes notice on behalf of the respondent Nos.1 to 3.

4. Though the petition is not entertained in view of the previous order, the first respondent should respond to any representation made by the petitioner regarding the alleged ineligibility of the private respondent in obtaining any benefit under the relevant scheme, within four weeks of the receipt of a further, detailed representation which may be carried by the petitioner to the District Collector within a fortnight from date.

WP No.21054 of 2021 is disposed of without any order as to costs.
