Civil Miscellaneous Second Appeal filed under Section 100 of the Code of Civil Procedure, 1908 to set aside the decree and judgement dated 21.12.2019 made in C.M.A.Nos.20 of 2017 & 3 of 2018 by the learned Principal District Court, Thiruvarur in confirming the decree and judgment dated 11.09.2017 made in H.M.O.P.Nos.9 of 2013 & 28 of 2013 on the file of the learned Sub Court, Mannargudi respectively. 1/4

For Appellant in both appeals : Mr.H.Manojin For Respondent in both appeals : Mr.S.R.Samithurai COMMON JUDGEMENT These Civil Miscellaneous Second Appeals have been filed challenging the decree and judgment dated 21.12.2019 made in C.M.A.Nos.20 of 2017 & 3 of 2018 by the learned Principal District Court, Thiruvarur.

It is seen from the records that these appeals were referred to Mediation by virtue of the order passed by this Court on 03.07.2023 and now the mediation has filed a report stating that the matter has been settled. Further, the Memorandum of Understanding (MOU), which was signed by all the parties, was also placed before this Court along with the Mediation report.

3. The learned counsel for the appellant as well as the respondent in unison would submit that these appeals may be allowed in terms of the said MOU.

4. Recording the above submission, this Court is inclined to allow these appeals in terms of the said MOU entered between the parties on 01.11.2023
