In the above matter, the plaintiff has been taking time to report on the availability of PW-1 for cross-examination. By order dated 23.07.2019, the learned Master has also recorded that PW-1 was not available. The learned counsel for the plaintiff has not confirmed the availability of his witness before this Court. Further, for the last three hearings there is no representation on behalf of the plaintiff and hence, the matter is listed under the caption 'for dismissal' today. Today also, there is no representation on behalf of the plaintiff and defendant has appeared.
