PRAYER: This Criminal Original Petition has been filed under Section 482 Cr.P.C. to direct the respondents to conduct further investigation in Crime No.427 of 2021 on the file of the 2nd respondent and include all the offences committed by the accused as stated in the complaint.

ORDER

This Criminal Original Petition has been filed to conduct further action in Crime No.427 of 2021 on the file of the 2nd respondent police.

2. The learned counsel for the petitioner would submit that the petitioner is the husband of the deceased, who consumed poison and later died, for which, First Information Report has been registered under Section 174 Cr.P.C. The in-laws of the petitioner made false allegations as against the petitioner as though the petitioner is the reason for the death of his wife. Hence, the petitioner and his minor children are harassed by the respondent police, under the guise of enquiry, at the instance of the in-laws of the petitioner.

3. The learned Additional Public Prosecutor would submit that in this case, investigation is in progress and the deceased herself had given a statement stating that nobody is reason for her to take extreme step of consuming poison and later, she died. The said statement has been attested by her father, namely, Kalidass. The family members of the deceased are also aware as to what reason she had taken the extreme steps and they have not made any complaint against the petitioner.

4. In view of the same, the petitioner's apprehension that he is being harassed is unfounded. Finding that investigation is proceeding on the right direction, this Court is inclined to close the petition without any order.

5. Accordingly, this Criminal Original Petition is closed.
