Prayer: This Criminal Original Petition has been filed under Section 482 of BNSS Act praying to enlarge the Petitioner on bail in the event of arrest in connection with the Crime No.40 of 2025 pending investigation on the file of the Respondent Police.

ORDER
The Petitioner who apprehends arrest at the hands of the Respondent Police for the offence punishable under Sections 3(2)(a), 4(1), 5(1)(a) of Immoral Traffic (Prevention) Act, 1956 in Crime No.40 of 2025, seeks anticipatory bail.
2. The case of the prosecution is that the Respondent Police had received a secret information from an informer that Petitioner and her friend have confined a girl in a room and forced her to involve in the immoral traffic activity against her willingness. Upon receipt of the said information, the Respondent Police secured the victim girl and registered a case in Crime No.40 of 2025 against the Petitioner and her friend.
3. Mr.K.Muruganandham, learned counsel for the Petitioner submitted that Petitioner's friend had involved in the alleged immoral traffic activity in his rental house and the Petitioner is not aware of the same. On 08.07.2025, the Respondent Police has arrested the Petitioner's friend. Based on the confession statement given by the Petitioner's friend, the 2/6
Respondent Police had included the Petitioner as Accused No.1 in the case in Crime No.40 of 2025.
3.1. The learned counsel for the Petitioner also submitted that Petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. The Petitioner has been falsely implicated in this case. Hence, the learned counsel prayed that anticipatory bail may be granted to the Petitioner.
4. Mr.A.Gopinath, learned Government Advocate (Crl.Side) appearing on behalf of the Respondent Police submitted that he has serious objection for granting anticipatory bail to the Petitioner.
5. Considering the nature of allegation and taking note of the fact that the custodial interrogation of the Petitioner is not necessary, this Court is inclined to grant anticipatory bail to the Petitioner with certain conditions.
6. Accordingly, the Petitioner is ordered to be released on bail in the event of arrest or on her appearance, within a period of fifteen days from the 3/6
date on which the order copy is made ready, before the learned IV Metropolitan Magistrate, Saidapet, Chennai - District, on condition that the Petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further conditions that: (a) The sureties shall affix their photographs and left thumb impression in the surety bonds and the learned Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identities;
(b) The Petitioner shall report before the Respondent Police everyday at 10.30 a.m., for a period of 30 days and thereafter, as and when required for interrogation; (c) The Petitioner shall not tamper with evidence or witness either during investigation or trial; (d) The Petitioner shall not abscond either during investigation or trial;
(e) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate 4/6
action against the Petitioner, in accordance with law as if the conditions have been imposed and the Petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in the case of P.K.Shaji Vs. State of Kerala reported in (2005) AIR SCW 5560; and (f) If the Petitioner thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S., 2023. 07.05.2026 mrr Index: Yes/No Speaking Order (or) Non-Speaking Order To 1.The IV Metropolitan Magistrate, Saidapet, Chennai - District.
