Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for a Writ of Mandamus, directing the second respondent to consider the representation dated 30.04.2019 and thereby direct the second respondent to take action against the 3rd respondent in pursuance to the proceedings of the second respondent in Na.Ka.No.88/2016 A2, dated 19.01.2018 addressed to the third respondent, who is running the said Mill in the residential premises at Old No.50, New No.268, Rajaveethi, Chengam 606 701, Thiruvannamalai District.

O R D E R

The petitioner has come forward with this Writ Petition for a mandamus, directing the second respondent to consider his representation dated 30.04.2019 and thereby direct the second respondent to take action against the 3rd respondent, pursuant to the proceedings of the second respondent in Na.Ka.No.88/2016/A2, dated 19.01.2018 addressed to the third respondent, who is running a Mill in the residential premises at Old No.50, New No.268, Rajaveethi, Chengam 606 701, Thiruvannamalai District, on the ground that the said Rice Mill has been functioning unauthorisedly without getting prior permission from the competent authorities and No Objection Certificate from the Tamil Nadu Pollution Control Board. 2.Today, when the matter was taken up for consideration, the learned Government Advocate appearing for the second respondent on instructions, submitted that the 3rd respondent, against whom, the writ petition has been filed, has passed away three years back and the Rice Mill in question is also not functioning as on date.

3.The aforesaid submission has been fairly conceded by the learned counsel for the petitioner.

4.In view of the subsequent development, this Court is of the opinion that no further orders are required to be passed in this Writ Petition, as the relief sought for herein has become infructuous.
