M/S Fujitsu General (Thailand) Company Ltd., v. Eta General Private Limited

A.Nos.2921 & 1574 of 2022 in C.S.(Comm.Div.)No.70 of 2022 SENTHILKUMAR RAMAMOORTHY,J The plaintiff has presented this application seeking permission for substituted service.

2. Registry has indicated that the summons was returned unserved with the endorsement that the defendant had vacated.

3. Learned counsel for the applicant points out that the pre-suit notice was sent to the same address and that such notice was replied to on 03.03.2022. It is also pointed out that the records of the Ministry of Corporate Affairs indicate that the address specified in the cause title is the correct address of the defendant. In these circumstances, this application is liable to be allowed.

4. Accordingly, the applicant is permitted to effect service by publication in one issue of the English Daily "Times of India" and one issue of Tamil Daily "Dhinathanthi", indicating the next date of hearing as 17.08.2022.
