ORDER
Today when the matter is taken up for hearing, the learned counsel for the petitioner and the learned counsel for intervener/defacto complainant submitted that pending the Anticipatory Bail application, the matter was referred to District Mediation and Conciliation Centre, Salem and the matter has been settled between the parties.
2. Learned Government Advocate appearing for the respondent would submit that the matter has been compromised between the parties pursuant to the mediation and the respondent Police has closed the case as mistake of fact.
3. When the Anticipatory Bail application is pending, this Court found that the dispute is between the siblings had referred this matter to District Mediation and Conciliation Centre, Salem. Through the mediation, the matter has been settled between the parties. The parties have entered into memorandum of agreement and the conditions of the settlement have also been complied with by the parties. Further, the respondent Police also taking into consideration the fact that the matter has been settled between the parties and the defacto complainant had referred the case in Crime No.26 of 2024 as mistake of fact and has filed the final report before the Judicial Magistrate, Salem stating that further action in Crime No.26 of 2024 stands dropped.
4. Recording the fact that the matter has been settled between the parties and final report also been filed stating that further action dropped, nothing survives for further adjudication in these petitions. Accordingly the petitions stands closed. 06-01-2025 msv To
