Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus to call for the records of the first respondent in Memo No.041953/627/G42/G.421/2019-4 dated 22.10.2020 and quash the same and consequently, direct the second respondent to consider the petitioner for the post of Heavy Vehicle Driver in the office of the third respondent. O R D E R
The petitioner challenging the impugned order of transfer, transferring the fourth respondent, by which the petitioner would be deprived of the opportunity of getting promoted as Heavy Vehicle Driver in the office of the third respondent, has filed the present writ petition.
2. According to the petitioner, he was working as Driver with the third respondent from 21.02.2013 and now working as Senior Driver and his next avenue of promotion is to the post of Heavy Vehicle Driver. But to this shock and surprise, vide impugned order dated 22.10.2020, the first respondent accommodated the fourth respondent in the said post and therefore, the petitioner's promotional opportunity has been denied. The petitioner, in this regard, has submitted a representation dated 28.10.2020 to the second respondent and the same is pending.
3. The learned counsel for the petitioner submitted that it would be suffice, if a direction is given to the respondents to consider the petitioner's representation dated 28.10.2020.
4. In view of the above, this Court directs the second respondent to consider the petitioner's representation dated 28.10.2020 and pass orders on merits and in accordance with law, as expeditiously as possible, within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
