The petitioner, who apprehends arrest for the alleged offence under Section 3(1) r/w 4 of POCSO Act, 2012, Crime No.11 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the minor victim girl was sexually assaulted by the petitioner on three occasions. Finally, on third occasion, the petitioner had given some juice to the victim girl and as such, the victim became sedative. Thereafter, the petitioner had committed penetrative sexual assault on the minor victim girl. Hence the complaint.

3. The learned counsel appearing for the petitioner submits that on the date of occurrence, the victim girl was very much available in the school. In fact, the petitioner had given a representation to the police, to conduct an enquiry and after enquiry, the petitioner was not alleged to have committed any offence. Hence, he prays to grant anticipatory bail to the petitioner.

4. On perusal of the records as well as the statement recorded under Section 164 of Cr.P.C revealed that the petitioner had committed aggravated penetrative sexual assault on the minor victim girl on three occasions. Therefore, the custodial interrogation of the petitioner is very much required in this case.

5. In view of the above, this Court is not inclined to grant anticipatory bail to the petitioner.
