Prayer: Writ Appeal filed under Cluse 15 of the Letters Patent, seeking to set aside the order, dated 09.05.2025 passed in W.M.P.No.17948 of 2025 in W.P.No.15868 of 2025.
ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard the learned Additional Solicitor General for the appellant and the learned Senior counsel for the respondent.
2. The respondent herein filed W.P.No.15868 of 2025 and the learned Single Judge has passed an order on 09.05.2025. Paragraph 11 of the said order reads as under:
"11. In view of the same, there shall be an interim direction to the respondent to provide access from GST Road with a width of 20 feet out of the total frontage of 120 feet. It is made clear that this is only an interim arrangement, by which, the petitioner will be having access to the property from the GST Road and the entire merits in the Writ Petition will be finally decided on 16.06.2025. Post the Writ Petition for hearing on 16.06.2025. The order shall be acted upon and the respondent shall forthwith open the fencing and provide access to the extent of 20 feet as indicated above
within two days from today."
3. Challenging the same, this Writ Appeal has been filed by the Defence Estate Officer, Madras Circle.
4. After hearing both sides, we are of the view that there are too many contentious aspects that will have to be gone into in the main writ petition. We therefore, dispose of the appeal by keeping the impugned direction on hold for a period up to 04.06.2025. We direct the Registry to list W.P.No.15868 of 2025 on 02.06.2025 itself. In other words, we are advancing the hearing of the writ petition from 16.06.2025 to 02.06.2025. We have not gone into the merits of the matter.
5.The Writ Appeal is disposed of accordingly. No costs. Consequently, connected CMP is closed.
