Second Appeal filed under Section 100 of the Code of Civil Procedure praying to set aside the decree and Judgment dated 05.04.2011 passed in A.S.No.3 of 2010 by the Principal District Judge, Vellore confirming the judgment and decree dated 20.11.2009 passed in O.S.No.109 of 1998 by the Subordinate Judge, Vellore allow the Second Appeal and dismiss the suit with costs.

J U D G M E N T
When the matter came up for hearing on 11.02.2026, the learned counsel for the appellant reported no instructions from his client and also made an endorsement to that effect and the same is extracted as hereunder:- "No instructions have been received from the appellant and there has been no response to the emails sent to the appellant and the calls made to his mobile number". Hence Registry was directed to print the name of the appellant in the cause list and list the matter on 18.02.2026 under the caption "for appearance of the appellant".
2. Today i.e., (18.02.2026) when the matter is called, the learned counsel for the appellant submitted that despite his best efforts, he was unable to contact his client and hence, he also reports no instructions in this matter. The appellant called absent. Learned counsel for the first respondent is present.

3. The second appeal is of the year 2014. It can now be inferred that the Appellant is not interested in prosecuting this second appeal. Accordingly, this Second Appeal shall stand dismissed for nonprosecution. No costs. Consequently, the connected miscellaneous petitions, if any, shall stand closed.
