ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.05.2026 for the alleged offences under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.63 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 01.04.2025 at about 3.15 p.m., based on secret information, the respondent police intercepted a car bearing Registration No. OD 01F 1119 near Arcot-Cheyyaru opposite to Sidheeswara Polytechnic and arrested A1 and A2. On enquiry, A1 allegedly confessed that ganja had been purchased from Odisha and transported to Tamil Nadu. The respondent police seized 60 kilograms of ganja from the car. It is further alleged that the petitioner had made arrangements for the purchase of the ganja. Hence, the case has been registered.

3. There is no representation on behalf of the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the quantity involved is 60 kilograms of ganja, which is a commercial quantity. The petitioner is arrayed as A7 in the case. It is further submitted that the petitioner has one previous case and that the case is presently posted for furnishing copies. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. This Court is of the view that the case involves seizure of 60 kilograms of ganja, which is a commercial quantity. Though no recovery is stated to have

been effected from the petitioner, the petitioner had made arrangements for the purchase of the ganja. Taking into consideration the nature of the allegations, and the fact that there is no representation on behalf of the petitioner, this Criminal Original Petition is dismissed as non prosecution. 08-06-2026 NSL To
