ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner seeking to modify the conditional in Para No.5(1) the petitioner is shall execute a bond for Rs.3,00,000/- (Rupees Three Lakhs only) along with two sureties in Crl.M.P.No.60 of 2026 on the file of the District Munsif cum 1/4

Judicial Magistrate Court, Uthukottai dated on 18.03.2026 and to allow the above Criminal Original Petition.

2. The learned District Munsif Cum Judicial Magistrate, Uthukottai while allowing the petition filed by the petitioner vide order dated 18.03.2026 in Crl.M.P.No.60 of 2026 imposed certain conditions and in one of the condition in Para No.5(1) that "the petitioner shall execute a bond for Rs.3,00,000/- (Rupees Three Lakhs only) along with two sureties.

3. The learned counsel for the petitioner submitted that the petitioner is unable to afford sureties possessing property worth Rs.3,00,000/- and because of the above he is unable to obtain his vehicle even after obtaining order from the Trial Court. Hence, he prayed to modify the said condition.

4. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

5. Considering the submission made by the learned counsel for the petitioner, this Court is inclined to modify the condition imposed by the learned District Munsif Cum Judicial Magistrate, Uthukottai in Para No.5(1) of the order dated 18.03.2026, in Crl.M.P.No.60 of 2026, and the same is read as follows: "the petitioner shall execute a bond for Rs.25,000/- (Rupees Twenty Five Thousand only) along with two sureties". The other conditions imposed on the petitioner in Crl.M.P.No.60 of 2026, dated 18.03.2026, shall remain intact.

6. With the above modification, this Criminal Original Petition is ordered.
