Crl.O.P.No.15266 of 2024 T.V.THAMILSELVI, J.

The petitioner, who was arrested and remanded to judicial custody on 06.05.2024 in Crime No.87 of 2023, for the alleged offence punishable under Section 12(1)(b), 12(2) of Passport Act r/w Section 420, 468, 471 of IPC, seeks bail.

2. Learned counsel appearing for the petitioner submitted that this the second bail petition and the earlier bail petition was dismissed by this Court in Crl.OP.No.13152 of 2024 dated 06.06.2024. He further submitted that the petitioner has been falsely implicated in this case, as if his name was not mentioned in the FIR and it appears that he was impleaded based on the confession of the arrested accused. He further submitted that the petitioner is suffering incarceration from 06.05.2024 and he is ready to abide any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that the petitioner along with other accused, forged a fradulent https://www.mhc.tn.gov.in/judis

passport in the name of one Hammed Mustafa, to board Malaysia, by altering his date of birth and place of birth, attempting to cheat the Government officials. He further submitted that the investigation is still pending and however, he opposed for the grant of bail to the petitioner.

4. Considering the facts and circumstances of the case and the submission made by the learned counsel on either side, and also the fact that the investigation is still pending and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition stands dismissed.
