C.M.P.No.5232 of 2016 in C.M.A.No.2181 of 2014 T.MATHIVANAN.J, This Civil Miscellaneous Petition has been filed by the petitioner seeking permission of this Court to withdraw the entire deposited amount along with entire accrued interest and costs lying in the credit of MCOP.No.485 of 2012 on the file of MACT/Additional District Court, Namakkal.

2. It is brought to the notice of this Court that in pursuant of the order of this Court dated 05.08.2014, the appellant had deposited 50% of the award amount with proportionate accrued interest and costs to the credit of MCOP.No.485 of 2012 on the file of MACT/Additional District Court, Namakkal.

3. Heard the learned counsel for the petitioner and the learned counsel for the first respondent.

4. Having been satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed. Accordingly, out of the deposited amount, the petitioner is permitted to withdraw a sum of Rs.3,00,000/- along with proportionate accrued interest and costs.

List the matter on 12.09.2016.
