PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents to release the payment due to the petitioner the tune of Rs.1,37,256/- in respect of Agreement No.DR/TWAD/No.16/2010-2011 dated 16.04.2010.

O R D E R

The relief sought for in the present writ petition is to direct the respondent to release the payment due to the petitioner to the tune of Rs.1,37,256/- in respect of Agreement No.DR/TWAD/No.16/2010-2011 dated 16.04.2010.

2. The issues are crystalised in view of the counter affidavit filed by the 2nd respondent. The learned counsel https://hcservices.ecourts.gov.in/hcservices/

appearing on behalf of the petitioner also has not disputed other issues except the statement made by the respondents that the payment due to the petitioner Contractor as per the agreement is Rs.1,37,256/-.

3. In view of the fact that the due amount to be paid by the respondent to the petitioner is not disputed, elaborate adjudication is not required. Accordingly, the respondents are directed to settle the payment due as admitted by them in their counter affidavit, i.e., Rs.1,37,256/- along with interest at the rate of 4% per annum from the date of filing of the writ petition till the date of realisation of the money.

4. With these directions, the writ petition stands disposed of. No costs.
