ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.04.2025, for the offences punishable under Sections 5(m) read with Section 6(l) of Protection of Children from Sexual Offence Act 2012 in connection with

Crime No.118 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the petitioner who is an Ex- Army man committed sexual assault to the minor victim girl aged about 10 years. Hence, the case.

3. Learned counsel for the petitioner would submit that petitioner is innocent and has been falsely implicated in this case. The learned counsel further submitted that the petitioner is suffering incarceration from 25.04.2025 and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and also produced the statement of the victim minor girl recorded under Section 183 of BNSS and vehemently opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case, the gravity of offence and the stage of investigation and on a perusal of the statement of the victim minor girl recorded under Section 183 of BNSS, this Court is not inclined to grant the relief sought for by the petitioner.
