PRAYER : Writ Petition filed under Article 226 of Constitution of India, to issue Writ of Certiorarified Mandamus to call for the records relating to 2nd respondent's endorsement bearing RC.No.30366/Rect.II (1)/2009 dated 01.10.2011 to quash the same in so far as it denies the rights of the petitioners for having their seniority fixed among the Sub Inspectors of Police belonging to Batch I of 1997 - 1998 recruits appointed on 16.04.1999 candidates as per the marks given in Police Training College to the batch I (1999) and consequently direct the respondents 1 to 3 to fix seniority of the petitioners among the Batch I candidates (1999) strictly on the basis of their Police Training Marks in the final examination with all consequential monetary and the service benefit. When the matter was taken up for hearing on 08.08.2024 there was no representation for the petitioners. Hence Registry was directed to list the matter on 12.08.2024 under the caption " for orders". Even today when the matter is taken up for hearing there is no representation on behalf of the petitioners.
2. The writ petition was filed for fixing seniority of the petitioners among the Sub Inspector of Police belonging to Batch I of 1997 - 1998 recruits appointed on 16.04.1999 as per the marks obtained in Police training final examination with all consequential benefits. The learned Additional Advocate General submitted that the writ petition has become infructuous as draft seniority for the year 1997 - 1998 for over all state was released and objections were also called for from affected persons.
3. The learned Additional Advocate General further submitted that the petitioners submitted their objections to the draft seniority list released on 31.01.2021.
4. In view of the submissions of the learned Additional Advocate General the writ petition is dismissed as infructuous as draft seniority list for the year 1997-1998 has already been released. It is needless to state that the respondents shall consider the objections of the petitioners to the draft seniority list for the year 1997-1998 in the manner known to law.
5. The writ petition is accordingly disposed of. No costs. Consequently, connected miscellaneous petitions are also closed. 12.08.2024 dpq Index : Yes /No Speaking Order : Yes/No
