ORDER
The petitioners/accused apprehend arrest for the alleged offence under Sections 303(2) of BNS Act read with Section 21(1) of Mines and Minerals (Development and Regulation Act, 1957 in Crime No. 202 of 2026 on the file of the respondent police seek anticipatory bail. 2.The case of the prosecution is that the defacto complainant,lodged a complaint alleging that the petitioner and other was illegally transported of 2 units of sand without any valid licence by a vehicle bearing No. TN 18 AQ 7273. Hence the case.
3. The learned counsel for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution; they have been falsely implicated in this case. He further submits that the petitioners, without prejudice to their defense and contention, are ready and willing to deposit an amount of Rs.1,000/- each to any association. Therefore, he prays for grant of anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case. He further submitted that the petitioners have illegally transported 2 units of sand. Hence, he opposed to grant anticipatory bail to the petitioners.
5.Considering the facts and circumstances of the case, and there is no previous case is reported as against the petitioners, also the fact that the petitioners have come forward to deposit an amount of Rs.1,000/- to the credit of "Tamil Nadu Advocate Clerk Association, Chennai", this Court is inclined to grant anticipatory bail to the petitioners on certain conditions.

Accordingly, the petitioners shall pay a sum of Rs. 1,000/- (Rupees One thousand only) each as cost to the Tamil Nadu Advocate Clerk Association, Chennai and on such payment, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate, JM-I Ponneri, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), each with two sureties, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions:
a)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; b)the petitioners shall report before the respondent police daily at 10.30 a.m., for two weeks and thereafter, as and when required for interrogation, until
further orders;
c)the petitioners shall not tamper with evidence or witness; d)the petitioners shall not abscond during trial; e)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
f) If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
