O R D E R

This petition has been filed to modify the condition imposed by the learned Principal Sessions Judge, Tiruppur in Crl.M.P.No.747 of 2016 dated 03.08.2016.

2. Heard the learned counsel for the petitioner; learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.

3. It is seen that this petitioner was arrested on 16.07.2016 in Crime No.219 of 2016 for offences under Section 447, 294[b] and 506[ii] IPC read with Section 3 of TNPPDL Act and is in judicial custody, since then. The petitioner moved Crl.M.P.No.747 of 2016 before the learned Principal Sessions Judge, Tiruppur for bail and the learned Judge, by order dated 03.08.2016, granted bail to the petitioner on condition that the petitioner should deposit a sum of Rs.50,000/- before the Judicial Magistrate, Tharapuram, at the time of furnishing sureties.

4. It is the case of the petitioner that he would not be able to mobilise the said amount, on account of which, he continues to be under incarceration, though bail was granted as early as 03.08.2016.

5. Taking into consideration the above fact, this Court is of the view that it will be in the interest of justice, if the deposit amount is reduced from Rs.50,000/- to Rs.15,000/-. Accordingly, the order dated 03.08.2016 in Crl.M.P.No.747 of 2016 passed by the learned Principal Sessions Judge, Tiruppur is modified to the effect that the petitioner shall deposit a sum of Rs.15,000/- instead of Rs.50,000/-. Rest of the conditions imposed by the Sessions Judge shall remain the same. Two weeks time is extended from the date of receipt of a copy of this order for furnishing sureties and depositing the amount.
