This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 06.03.2025, seeking bail in Crime No.201 of 2025 registered for the offences under Sections 191(2), Page No.1 of 5

191(3), 61(2) and 103 r/w Section 190 of BNS Act.

2. It is the case of the prosecution that the petitioners had attacked the deceased with a knife, where the deceased sustained injuries and died while being taken to the hospital. Hence, the case.

3. The learned counsel for the petitioners would submit that the petitioners are innocent and he has been falsely implicated in this case. He would further submit that the petitioners are in custody from 06.03.2025, and that in any case, further custody of the petitioners is not required and prayed for grant of bail to the petitioners.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police, while opposing the grant of bail to the petitioners, reiterated the prosecution case and submitted that the allegation against the petitioners is grave in nature, involving a fatal assault resulting in the death of an individual. He further submitted that the investigation is at a crucial stage and releasing the petitioners at this juncture may hamper the ongoing Page No.2 of 5

investigation and adversely impact the witnesses, particularly when other accused are also involved in the offence.

5. Heard learned counsel on either side and perused the materials available on record.

6. Considering the gravity of the offence, the stage of the investigation, and the possibility of tampering with evidence or influencing witnesses if the petitioner is released on bail, this Court is of the view that this is not a fit case to grant bail at this stage.
