PRAYER:

The writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified mandamus, calling for the entire records relating to the impugned order passed by the 1st respondent in Na.Ka.4853/2014/Tho.Vae.Sa(1), dated 11.12.2014 and quash the same and consequently directing the 4th respondent to conduct proper enquiry as per order dated 14.11.2014 passed in W.P.No.29618 of 2014.

The petitioner has filed this Writ Petition to issue a Writ of Certiorarified mandamus, calling for the entire records relating to the impugned order passed by the 1st respondent in Na.Ka.4853/2014/Tho.Vae.Sa(1), dated 11.12.2014 and quash the same and consequently directing the 4th respondent to conduct proper enquiry as per order dated 14.11.2014 passed in W.P.No.29618 of 2014.

2. The learned counsel for the petitioner submitted that pursuant to order of this Court, the first respondent has passed the impugned order. Therefore, the present writ petition has become infructuous. In view of the above fact, the learned counsel for the petitioner made an endorsement to withdraw the said writ petition with liberty to file a fresh writ petition.

3. In the light of the above, the writ petition is dismissed as withdrawn with liberty to the petitioner to challenge the subsequent order passed by the second respondent dated 06.01.2015. No costs.
